1. Agreement
These Terms of Service ("Terms") are a legal agreement between you and Sydentia Oy ("Sparky", "we", "us") governing your use of the Sparky app and service. By creating an account or using Sparky, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use Sparky.
2. Eligibility
You must be at least 16 years old to use Sparky. By using Sparky you confirm that you meet this requirement and that the information you provide is accurate.
3. What Sparky is — and what it is not
Sparky is a private, reflective wellbeing companion. It helps you journal, reflect across areas of your life, talk things through with an AI companion, take a personality questionnaire, run guided reflections, and (optionally) connect and chat with people you choose.
Sparky is not a medical, clinical, psychological, therapeutic, legal, or financial service, and does not provide professional advice or diagnosis. Sparky is not a crisis or emergency service. If you are in distress or think you may harm yourself or others, contact a qualified professional or your local emergency services. Sparky may surface a "Resources" shortcut when it detects possible distress, but this is not a substitute for professional help.
4. AI-generated content
Sparky's replies, summaries, reflections, and insights are generated by artificial intelligence (using OpenAI as our AI provider). AI output may be inaccurate, incomplete, or unsuitable for your situation. Use your own judgement and do not rely on Sparky for decisions that need professional advice. See the Privacy Policy for exactly what content is sent to our AI provider and how.
5. Your account
You are responsible for keeping your sign-in credentials secure and for activity under your account. Sign in with email/password, Google, or Apple. Notify us at support@sydentia.com if you suspect unauthorised use.
6. Your content
You keep ownership of the reflections, entries, messages, and other content you create ("Your Content"). You grant us a limited licence to host, store, process, and transmit Your Content solely to operate and provide Sparky to you (including sending relevant content to our AI provider to generate the results you request, as described in the Privacy Policy). We do not sell Your Content and we do not use it to advertise to you beyond the clearly labelled, non-personal sponsored suggestions you can disable.
7. Acceptable use
When using Sparky — especially the social/people-chat features — you agree not to:
- harass, threaten, abuse, defame, or harm other people;
- post or send content that is illegal, hateful, sexually exploitative (especially involving minors), or that infringes others' rights;
- add or message people who have not agreed to connect with you;
- attempt to access other users' data, disrupt the service, or circumvent security or usage limits;
- use Sparky to provide professional advice to others or to impersonate anyone.
You are responsible for the content you create and send. We may remove content or suspend or terminate accounts that violate these Terms.
8. Subscriptions, in-app purchases, and auto-renewal
Sparky is free to use, with optional paid subscriptions ("Sparky Pro" and higher tiers) and in-app purchases that unlock additional features. The following terms apply to auto-renewing subscriptions:
- What you get and for how long. Paid tiers (Pro, Premium, Unlimited) are offered on a monthly or annual basis and unlock the features described at the point of purchase.
- Price. The price is shown in the app before you confirm, in your local currency, via the App Store or Google Play.
- Auto-renewal. Subscriptions renew automatically for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period. Your store account is charged for renewal within 24 hours before the period ends.
- Managing and cancelling. You manage or cancel your subscription in your Apple App Store or Google Play account settings — not in the Sparky app. Deleting the app does not cancel a subscription.
- Payment and refunds. Payment is charged to your App Store or Google Play account. Refunds are handled by Apple or Google under their policies; we do not process store payments directly.
- Free trials / offers, if any, convert to a paid subscription unless cancelled before the trial ends; unused trial time is forfeited when you buy a subscription.
9. Sponsored suggestions
Sparky may show clearly labelled sponsored suggestions from partners. They are always marked, never disguised as your own content, and never shown during sensitive moments. No user data is shared with advertisers (see the Privacy Policy). You can turn off sponsored suggestions and personalization, or hide individual advertisers, in Settings.
10. Termination and deletion
You may stop using Sparky and delete your account at any time in Settings → Delete account (this is immediate and irreversible; see the Privacy Policy for what is deleted and what is retained in de-identified form). We may suspend or terminate your access if you materially breach these Terms or use Sparky unlawfully. Sections that by their nature should survive termination (e.g. content licence for retained de-identified data, disclaimers, limitation of liability, governing law) will survive.
11. Disclaimers
Sparky is provided "as is" and "as available", without warranties of any kind to the extent permitted by law. We do not warrant that Sparky will be uninterrupted, error-free, or that AI output will be accurate or fit for a particular purpose. Nothing in these Terms limits rights you have as a consumer under mandatory Finnish or EU law.
12. Limitation of liability
To the extent permitted by law, Sydentia Oy is not liable for indirect, incidental, or consequential damages, or for loss of data or profits, arising from your use of Sparky. Nothing in these Terms excludes liability that cannot be excluded under mandatory law (including liability for death or personal injury caused by negligence, or your statutory consumer rights).
13. Governing law and disputes
These Terms are governed by the laws of Finland, without regard to conflict-of-laws rules. Mandatory consumer-protection rights in your country of residence still apply. Consumers in Finland may also refer disputes to the Consumer Disputes Board (kuluttajariita.fi) and the Consumer Advisory Services.
14. Changes
We may update these Terms as Sparky evolves. We will post the updated version with a new date and, for material changes, notify you in the app. Continued use after changes take effect means you accept the updated Terms.
15. Apple-specific terms
If you download Sparky from the Apple App Store, the following also apply and, in case of conflict with the rest of these Terms, govern for the Apple App Store version:
- This agreement is between you and Sydentia Oy only, not with Apple. Apple is not responsible for Sparky or its content.
- Apple has no obligation to provide maintenance or support for Sparky.
- If Sparky fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation for Sparky.
- Apple is not responsible for addressing any claims relating to Sparky, including product-liability, legal/regulatory, or consumer-protection claims, or third-party claims that Sparky infringes intellectual-property rights.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting", and are not on any U.S. Government prohibited-parties list.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
